Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Unimelon LLC ("Growva," "we," "our," or "us"), governing your access to and use of the Growva loyalty platform and related services.

By accessing or using Growva, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the service.

Description of Service

Growva is a loyalty platform that helps cafés, restaurants, and similar businesses reward their customers. The service allows customers to earn points through check-ins or purchases and redeem rewards at participating businesses. Businesses can manage loyalty programs, track customer engagement, and analyze performance through our dashboard.

Eligibility

To use Growva, you must:

• Be at least 13 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the service under applicable laws
• For business accounts: have authority to bind your business to these Terms

User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:

• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Keeping your contact information up to date

Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the service
• Manipulate or abuse the rewards system (e.g., fake check-ins, multiple accounts)
• Interfere with or disrupt the service or servers
• Transmit viruses, malware, or other harmful code
• Impersonate another person or entity
• Use automated systems to access the service without permission
• Resell or redistribute the service without authorization

Rewards and Points

Regarding the loyalty rewards program:

• Points and rewards have no cash value and cannot be exchanged for money
• Reward availability is determined by participating businesses
• We reserve the right to modify, suspend, or terminate rewards programs
• Points may expire according to individual business policies
• Fraudulent activity will result in forfeiture of all points and potential account termination

Pilot Program

For businesses participating in our pilot program:

• The pilot is provided free of charge for the specified duration (typically 30 days)
• Pilot features and availability may change without notice
• We may collect feedback and usage data to improve the service
• Pilot participation does not guarantee future access or pricing
• Either party may terminate pilot participation at any time

Intellectual Property

The Growva service, including its original content, features, and functionality, is owned by Unimelon LLC and is protected by intellectual property laws. You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or branding without authorization
• Reverse engineer or attempt to extract source code

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNIMELON LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless Unimelon LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the service or violation of these Terms.

Termination

We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the service will cease immediately. All provisions of these Terms that should survive termination shall survive.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Connecticut.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the service after changes constitutes acceptance of the modified Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
